Terms and Conditions |

1-Basic condition
Business dealings between GSG International and its customers are governed solely by the following general conditions of sale, excluding any other type of agreement, unless this is agreed in writing. Insertion of an on-line order also implies total acceptance of the following conditions.
2-Customers
GSG International through the site nettosecurity.com sells exclusively to:
- Dealers in hardware and software;
- System integrators;
- Dealers in household appliances
- Installers of aerials;
- Installers of burglar alarms;
- Parties who, pursuant to current retail regulations, are authorised – as documented by the Chamber of Commerce search report – to resell information technology material, electrical and electronic material, consumer electronic material, and audiovisual or photographic material.
3-Liability
GSG International is not liable for any damage or loss, direct and/or indirect, stemming from the sale of goods and services proposed in the catalogue published on the www.nettosecurity.com site, also relating to late and/or non-delivery of the product, nor is it liable for the match of merchandise with the specifications published on the site, or for any other fact not directly attributable to GSG International.
4-Technical information
Technical information presented on the Website www.nettosecurity.com is taken from the information published by the manufacturers of the goods included in our catalogue. GSG International therefore reserves the right to amend/update the technical and size information concerning products in the catalogue, based on information received from manufacturers, also without any prior notice.
5-Orders
Orders are accepted only and exclusively in writing via Internet (on-line). Customers sending orders via Internet will receive, at the end of the procedure, on-line confirmation of order acceptance, or confirmation via e-mail, with the indication of the relevant “order number”. If, after transmission of the order, the “order number” does not appear after a few minutes, the proposed order shall be taken not to have been accepted, for all legal intents and purposes, even if this is because of accounting or administrative reasons or because of non-availability of products.
6-Prices
All prices indicated on the site, in the Price column, are prices for resellers – excluding VAT.. Prices can be modified at any time, without any prior notice.
7-Product availability
In the product catalogue published on the www.nettosecurity.com site, all products are available in 5 days. Since on-line access and ordering cause real-time changes in product availability, GSG International does not guarantee certainty of assignment of merchandise ordered until the order has been confirmed by email.
8-Shipment and delivery
Unless otherwise agreement, shipments will be performed using carriers chosen by GSG International or its delegate. In this case, merchandise travels at GSG International’s risk. In the case of theft/mislaying of goods, GSG International undertakes to send a new product and, if the latter is now available and/or is out of stock, it will propose a different product – but with equivalent characteristics – with the customer having the right not to accept this new product and to request issue of a credit note for the product concerned.
Delivery times and costs – purely as provisional estimates to give an idea of time and entity – are sent to customer by email. Delivery time may undergo changes due to force majeure or to traffic conditions or to road conditions in general or to acts by the authorities. Saving any different written agreement between the parties, delivery will be made to the ground floor of customer premises and during business hours, i.e. from 8.30 a.m. to 12.30 p.m. and from 2 p.m. to 6 p.m. CET, every day, excluding public holidays, from Monday to Friday.
9-Risk and ownership
Merchandise is shipped on carriage-paid-to basis, with insurance. Upon delivery of merchandise, the customer must check that parcels are intact and that quantity and quality corresponds to what is indicated in the accompanying freight document (AFD). If there are discrepancies, these must be indicated on the accompanying freight document and be confirmed to GSG International, within seven days, via fax or recorded-delivery/receipt mail addressed to the relevant account manager . Even if packaging is intact, merchandise must be checked within seven days of receipt. Any hidden anomalies must be notified in writing via fax or recorded-delivery/receipt mail. Any notification later than the aforementioned deadlines will not be taken into consideration. The customer takes full responsibility for every statement made.
10-Payments
Merchandise supplied must be paid for via credit card or advance bank transfer, saving any different conditions that must be agreed upon in writing with GSG International.
GSG International reserves the right, based on its own unquestionable judgement, not to proceed with shipment of goods, even after having accepted the order, to those customers found to be “beyond credit limit”, or “in arrears”, or “undergoing legal recovery”.
11-Right to cancel orders
The customer can ask to cancel an order in its entirety or in part. GSG International reserves the right to accept cancellation of the order. Requests for order cancellation (and their acceptance) must take place sending an email or fax.
12-Return of merchandise
Return of merchandise to GSG International must be requested via fax or via email, indicating the reasons for the request and the reference details of the invoices and/or AFD and must be expressly authorised via email. Return of merchandise must be performed after receipt of authorisation via email and assignment of the “Return number” and within 10 working days after the date of approval of the request to return merchandise. The amounts of the merchandise returned will be subject to deduction (see the amounts in the on-line request form for the return of merchandise) if the product:
- Although perfectly intact (sealed), has been specifically ordered by GSG International from its vendor
- Is declared to have been opened
- Is declared in the form sent via email not to have been opened, whereas in reality it has been opened
- In cases when it reaches GSG International premises more than 10 working days after issue of the authorisation to return it.
The merchandise to be returned must be in mint condition, in its original packaging, and shipped carriage-paid to our warehouse, indicating, in the accompanying document, the Return Number assigned.
13-Complaints
Any shipment errors or missing items must be notified, in writing and/or via email, in the way and by the deadlines indicated in point 9.
14-Warranties
The purchase of products from GSG International using www.nettosecurity.com website involves total acceptance of the conditions of warranty provided by the manufacturer, which may be independent from GSG International’s own policy. The customer is therefore aware that the merchandise purchased will be guaranteed by the manufacturer and at the conditions established by the latter and therefore unreservedly accepts all methods of provision of the manufacturer’s warranty, also as regards, purely by way of example, a party managing the warranty other than GSG International.
15- Handling and processing of personal data
Pursuant to Italian Legislative Decree no. 196 of June 30th 2003, the customer officially acknowledges that the “personal data” communicated and/or exchanged, also during the phase of pre-contractual information collection, will be handled and processed, pursuant to Italian Legislative Decree no. 196/2003, for the intents and purposes indicated in Article 24, paragraph 1, letter b), and subsequent amendments and additions to the said Legislative Decree 196/2003. In addition, it remains understood that the customer expressly gives his/her consent to transfer of “personal data” pursuant to and for the purposes of Article 43, paragraph 1, letter b), of Italian Legislative Decree 196/2003 and, in any case, to their communication and dissemination.
16-Controversies
For any controversy that might arise, the Milano Law Court will be the competent court.
17-Conditions
The conditions contained in the present document may be changed, without any prior notice, and will be valid as from the date of publication on the Website www.nettosecurity.com
